Welcome to EarlyFit! This Consent Notice (“Notice”) is provided by EarlyFit Health Private Limited (“EarlyFit,” “we,” “us,” or “our”) as part of our commitment to protect the personal data of Users (“User,” “you,” or “your”). This Notice applies to the use of the EarlyFit mobile application (“App”) and website (“Website”), collectively referred to as the “Platform.” By agreeing to this Notice, you confirm your understanding and acceptance of its key terms. We encourage you to read our full Terms and Conditions and Privacy Policy before providing your affirmative consent.

1. Using Your Health Data for the Program

You provide your explicit and affirmative consent for EarlyFit and its affiliates (including Menwell Limited, our parent entity incorporated in the United Kingdom) to collect, use, store, share, transfer or otherwise process your personal data, which may include:

• Identifiable data (e.g., name, email, contact details) provided during onboarding and account creation;
• Financial data for purchasing EarlyFit programs;
• Technical data (e.g., IP address, browser, device data);
• Communications with us, whether oral or written;
• Medical history and current conditions;
• Current medications;
• Laboratory test results;
• Data from connected devices (e.g., Continuous Glucose Monitor (CGM), smart scale, fitness trackers);
• Data from activity fitness trackers (e.g., Apple HealthKit, Google Health Connect);
• Biometric data (e.g., heart rate, glucose levels);
• Survey data from “My Metabolic Print”;
• Meal logs;
• Data provided orally and digitized for our records;
• Notes from interactions with your assigned Care Team (doctors, nutritionists, physical therapists, psychologists).

2. Purpose of Processing Personal Data

We use your personal data to provide services, including:

• Creating an account on the EarlyFit Platform;
• Developing your personalized weight loss plan;
• Offering consultations;
• Connecting you with medical professionals;
• Facilitating orders of prescribed medications from licensed partner pharmacies;
• Booking diagnostic blood tests with partner laboratories;
• Managing subscription payments and financial transactions;
• Tracking your progress;
• Providing access to Platform services.

Your personal data may also be shared with our affiliates, including Menwell Limited (our parent entity incorporated in the United Kingdom), who may independently determine the purpose of processing your personal data, including:

• Group analytics and insights;
• Product development and service improvement;
• AI and machine learning development;
• Group operations and business administration; and
• Benchmarking and statistical research.

3. Telehealth Consultations with Our Care Team

You consent to receiving medical consultations, advice, and therapy from EarlyFit's affiliated doctors, nutritionists, physical therapists, and psychologists via telecommunication methods (e.g., video calls, audio calls, chat) through the Platform. You understand that telehealth offers benefits like convenience but has limitations, such as the absence of a physical examination.

4. Understanding Prescription Medications (e.g., GLP-1 Agonists)

You acknowledge that the EarlyFit program is medically supervised and may involve prescription medications (e.g., GLP-1 agonists like tirzepatide, semaglutide, or metformin) if deemed appropriate by an EarlyFit-affiliated doctor after consultation. The doctor is responsible for discussing the medication's benefits, risks, and potential side effects with you. You must provide informed consent directly to the doctor for such treatment and promptly report any side effects to your Care Team.

5. Accuracy of Data You Provide (Especially Orally)

You agree to ensure that personal data shared with EarlyFit staff or your Care Team, particularly during unrecorded phone or video calls, is accurate and complete. EarlyFit relies on this data and is not responsible for issues arising from incorrect or incomplete information provided by you.

6. Allowing EarlyFit to Help with Lab Tests and Medications (One-Time Opt-In)

As part of the EarlyFit program, you provide explicit permission for EarlyFit to act on your behalf for the duration of your program to:

• Book diagnostic blood tests with partner laboratories, sharing relevant personal and health details (e.g., test requisitions) for this purpose;
• Order prescribed medications from licensed e-pharmacies or local pharmacies, sharing your prescription, contact details, and delivery address. You confirm that your contact and delivery data are accurate.

This permission is a one-time opt-in for the duration of your program.

7. Using Data from Connected Devices

You consent to EarlyFit collecting, using, and displaying data from connected devices (e.g., CGMs, EarlyFit smart scale) and third-party health platforms (e.g., Apple HealthKit, Google Health Connect) to support your program. You understand that EarlyFit is not responsible for the accuracy of data from third-party devices or platforms.

8. EarlyFit Is NOT for Emergencies

You understand and agree that the EarlyFit Platform and services are not for medical emergencies. In case of a medical emergency, you must immediately contact local emergency services (e.g., call 108 or 112 in India) or visit the nearest hospital.

9. Your Responsibility for Program Success

You agree to provide truthful, accurate, and complete data, especially about your health, and understand that program success depends on your active participation and commitment to following personalized plans and medical advice from your Care Team.

10. Withdrawal of Consent

You may withdraw your consent for the processing of your personal data at any time by contacting [email protected]. EarlyFit will cease processing your personal data upon withdrawal, but may retain or share data with government authorities as required by applicable law.

11. Accessing Rights Under the Digital Personal Data Protection Act (DPDPA)

The DPDPA provides you with the following rights:

• Access to a grievance redressal mechanism and Data Protection Officer for complaints;
• Nomination of an individual to exercise your rights in case of death or incapacity;
• Ability to provide, review, withdraw, or manage consent via a consent manager;
• Withdrawal of consent with ease comparable to giving consent;
• Request completion, updating, correction, or erasure of personal data;
• Receipt of a notice with consent requests, informing you of your right to withdraw and how to complain to the Data Protection Board.

12. Redressal with the Data Protection Board

If you are unsatisfied with EarlyFit's grievance redressal mechanism or wish to escalate a matter to the Data Protection Board established under the DPDPA, you may do so by contacting [email protected] with your concerns.

13. Your Confirmation

By agreeing to this Notice, you confirm:

• You are at least 18 years old and reside in India;
• You have read, understood, and agree to this Notice;
• You agree to the full Terms and Conditions and Privacy Policy.
